Acceptable Use Policy for DataMagik Platform

Introduction
This Fair Use Policy ("Policy") governs your use of the DataMagik platform and services. By using DataMagik, you agree to comply with this Policy. Violation of this Policy may result in suspension or termination of your account and access to our services.
DataMagik is designed to enhance manufacturing data workflows and productivity. We expect all users to use our platform responsibly, lawfully, and in a manner that respects the rights of others and the integrity of connected systems, including Plex by Rockwell Automation.
Acceptable Use
You may use DataMagik services for:
- Legitimate Business Activities: Document generation, data automation, workflow management, and CRM operations for lawful business purposes
- Manufacturing Data Management: Extracting, processing, and managing data from Plex and other manufacturing systems within the scope of your authorized access
- Automation and Integration: Creating scripts, workflows, and integrations that improve efficiency and productivity
- API Integration: Developing third-party integrations using our documented APIs within rate limits and quotas
- Document Generation: Creating PDFs, HTML documents, and reports from your templates and data
- Collaboration: Sharing documents, templates, and workflows within your organization
Prohibited Activities
You may NOT use DataMagik to:
Illegal Activities
- Engage in any illegal activity or facilitate illegal conduct
- Violate any applicable local, state, national, or international law
- Infringe on intellectual property rights of others
- Distribute malware, viruses, or malicious code
- Engage in fraud, phishing, or identity theft
System Abuse and Attacks
- Launch denial-of-service (DoS) or distributed denial-of-service (DDoS) attacks
- Attempt to gain unauthorized access to our systems or other users' accounts
- Probe, scan, or test the vulnerability of our systems without permission
- Bypass or circumvent security measures, rate limits, or access controls
- Use automated tools to scrape or harvest data from our platform
- Reverse engineer, decompile, or disassemble our software
Abuse of Plex by Rockwell Automation
- Access Plex systems beyond your authorized permissions
- Extract data from Plex in violation of your organization's policies or Plex terms of service
- Overwhelm Plex systems with excessive API calls or automated requests
- Use DataMagik to circumvent Plex security controls or data access restrictions
- Modify, delete, or corrupt data in Plex systems without authorization
- Share Plex credentials or authentication tokens with unauthorized parties
Resource Abuse
- Exceed license quotas or generate excessive documents to abuse storage resources
- Run automation scripts that consume excessive computing resources
- Create infinite loops or poorly optimized code that degrades system performance
- Use the platform for cryptocurrency mining or similar resource-intensive operations
- Resell or sublicense access to DataMagik services without authorization
Harmful Content and Conduct
- Upload or distribute content that is defamatory, obscene, or offensive
- Harass, threaten, or intimidate other users
- Distribute spam, unsolicited communications, or chain letters
- Impersonate another person or entity
- Violate the privacy rights of others
Data Misuse
- Access, collect, or store data you are not authorized to access
- Share confidential or proprietary information without authorization
- Use DataMagik to exfiltrate data from your organization in violation of company policies
- Store or process personal data in violation of privacy laws (GDPR, CCPA, etc.)
- Use customer data for purposes other than the intended business use
Rate Limits and Quotas
To ensure fair usage and system stability, DataMagik enforces the following limits:
- API Rate Limits: Requests are limited based on your license tier. Excessive requests may be throttled or blocked.
- Document Generation Quotas: Monthly document generation limits are enforced per license tier.
- Storage Limits: Storage consumption is tracked and limited based on your subscription.
- Automation Script Execution: Script execution time and frequency are monitored to prevent resource abuse.
- Concurrent Requests: Simultaneous API requests are limited to prevent system overload.
If you consistently approach or exceed these limits, we may contact you to discuss upgrading your plan or optimizing your usage patterns.
Security Requirements
You are responsible for:
- Maintaining the confidentiality of your account credentials and API tokens
- Immediately notifying us of any unauthorized access or security breach
- Using strong passwords and enabling multi-factor authentication (MFA)
- Ensuring that automation scripts and integrations follow security best practices
- Regularly reviewing API tokens and revoking unused or compromised credentials
- Complying with your organization's security policies when using DataMagik
- Properly configuring document TTL settings to avoid storing sensitive data unnecessarily
Third-Party System Interactions
When using DataMagik to interact with third-party systems (including Plex by Rockwell Automation):
- You must have proper authorization to access those systems
- You agree to comply with the terms of service and acceptable use policies of those systems
- You are responsible for any actions taken through DataMagik on third-party systems
- You must respect rate limits, data access restrictions, and usage policies of those systems
- You acknowledge that DataMagik is an independent service and is not endorsed by or affiliated with Plex by Rockwell Automation
Monitoring and Enforcement
To protect our platform and users, we reserve the right to:
- Monitor usage patterns and system activity for compliance with this Policy
- Investigate suspected violations of this Policy
- Temporarily or permanently suspend accounts that violate this Policy
- Remove or disable access to content that violates this Policy
- Cooperate with law enforcement investigations
- Modify or terminate services to prevent abuse
- Implement additional security measures or restrictions as needed
Consequences of Violation
Depending on the severity of the violation, we may:
- Issue a Warning: First-time minor violations may result in a warning and request for corrective action
- Temporary Suspension: Repeated or moderate violations may result in temporary account suspension (7-30 days)
- Permanent Termination: Serious violations, illegal activity, or repeated offenses will result in permanent account termination
- Legal Action: Criminal activity or actions that cause significant harm may result in legal proceedings
- Financial Liability: You may be held financially responsible for damages caused by your violations
We reserve the right to take immediate action without prior notice for serious violations that pose a threat to our systems, users, or third parties.
Reporting Violations
If you become aware of any violation of this Policy or suspect abuse of the DataMagik platform, please report it immediately to:

Disclaimer of Warranties
DataMagik is provided "as is" without warranties of any kind. While we strive to maintain a secure and reliable platform, we do not guarantee uninterrupted access or error-free operation. You use DataMagik at your own risk and are responsible for implementing appropriate backup and disaster recovery procedures for your data.
Limitation of Liability
To the maximum extent permitted by law, Chupp Consulting L.L.C. and DataMagik shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of or inability to use our services, including but not limited to data loss, business interruption, or loss of profits. Our total liability shall not exceed the amount paid by you for the services in the 12 months preceding the claim.
Indemnification
You agree to indemnify, defend, and hold harmless Chupp Consulting L.L.C., DataMagik, and its affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your violation of this Policy, your use of our services, or your violation of any third-party rights.
Changes to This Policy
We may update this Fair Use Policy to reflect changes in our services, legal requirements, or industry best practices. We will notify users of significant changes through the platform interface, email notifications, or prominent notices on our website. Continued use of our services after changes become effective constitutes acceptance of the updated policy.
Governing Law
This Policy shall be governed by and construed in accordance with the laws of the State of Michigan, United States, without regard to its conflict of law provisions. Any disputes arising from this Policy shall be resolved in the courts of Michigan.
